The market is continually changing in obtaining finance for buy to let properties that need to be refurbished. There are still a number of schemes available and below is a list of the most popular:

1. Open bridge/remortgage within 6 months

The open bridge purchases the property with a loan of up to 75% of the open market value, which cannot exceed 100% of the purchase price. After the works have been completed a remortgage is arranged to 70% of the new value.

2. Open bridge and sale within 6 months

As above but the property is purchased by someone else and then sold to you at 75% of its new value.

What is the tax situation wrt reinvesting profits?

e.g. If I make a profit of 5000 on a property & reinvest this within the tax year, am I liable for tax on the 5000?

If the property is held by a company & the profit reinvested, is the tax position the same?

High stamp duty a significant deterrent

The real estate wave passes through different phases. Currently in India particularly in Kerala, the wave is on a rise. This is mainly due to the increased inflow of foreign investments, and the arrival of new high profile projects like the Smart City, and Vallarpadam Container Terminal etc in Kochi. Kochi is the economic and IT capital of this small coastal state In India.

Likewise, there are other factors like rising bank rates, stamp duty etc, which curbs the real estate boom in any area. Real estate Kochi has been seeing a real boost in the past couple of years. This has been in direct response to the number of developmental projects in the offing.

However, with banks rates rising, many people are thinking twice before investing in immovable properties. It is to be hoped that the current stamp duty will not only not be hiked but also will be significantly reduced to encourage people to invest more in Real estate Kochi .

The stamp duty often acts as a significant deterrent to property deals, especially when the duty rates are high. It can reduce the volume of transaction, and hinder transfer of property. A smoothly functioning market in property serves a useful economic purpose.

Often when the stamp duty is high, many property transactions are deferred. Even when transactions do take place, these are recorded at values less than the full consideration paid for. High stamp duty rates lead to under-valuation of the transaction and results in revenue loss.

Stamp duty is a tax payable to the government. The under-declaration of property value to evade this tax results in the making of black-market money

Unlike in India there is no attempt to evade the duty by under-valuation in UK. Constant efforts at rationalization in response to the public demand and market forces result in frequent changes in the structure of duties in UK. In Australia, stamp duty rates are very low and in certain cases have been exempted.

In India, some States levy very high rates of stamp duty. There is a positive move by various policy makers to reduce stamp duty and to increase the flow of property transactions in the Indian market.

Appreciating in value due to high rentals

The interventions of the government on rental housing through the Rent Control Act and the system of property taxation were both negative and ill timed. Under the latter, the landlords renting out their properties were liable to higher taxation than the owner-occupiers. This reduces the return on the premises and thus leads to underreporting of tenancies.

The Rent Control Act has led to the emergence of various illegal payment practices and distortions in the rental market. At the same time, the Act is not the villain of the piece as far as lesser investments in rental housing is concerned. Meanwhile, the beneficiaries in older housing developed vested interests in the preservation of low rents and opposed any steps for raising rents with the increase in inflation. Faced with high costs of ownership housing, and with their entry to private rental market barred by high rents and landlord reluctance, it is the lower income groups in the unorganized sector who mainly suffer from the present situation. When considering the continuing appreciation in Real Estate Trivandrum city and its suburbs are witnessing such a trend mainly due to the high demand for housing and commercial spaces.

As regards the management of rental properties, we can understand the problems faced by the state agencies in maintaining the built up structures and common services after the payment of local taxes out of the low rents. Here, they are constrained as much by the political will to raise rents as by the failure to involve the tenants in the management of the properties. The private rental market is desperate, and the maintenance is much better on properties let out at or more than the economic rent.

The severe problem faced by the continuous neglect of old properties with low rents, and the inaction of landlords, has spurred at least one state in India to enact legislation to bypass the Rent Control Act for ensuring systematic structural repairs on a participative funding basis. The high site values in the core city areas afforded little encouragement to landlords to keep the premises in good condition, rather they tempt the landowner to pray for a house collapse, or to devise stratagems to throw out the tenants.

Do Section 21 Notices Have a Shelf Life after they Expire?

Can anyone tell me if, after a Section 21 Notice expires there is then a deadline by which possession proceedings have to commence?

One of our tenants was served a sec 21 which expired on 19th Jan this year. It was put to one side after we began to get a response from the tenant but he has since reneged on our post sec 21 agreement. We want to commence possession proceedings against him but we do not want to have to issue another sec 21 with the delay that this will entail. Can anyone advise us on this?

tenant didn't pay rent,broke the flat

Please help. I own a flat near Glasgow, Scotland, and had a tenant in place,and managed by an agency. However, for 6 months now, the tenant payed lot less rent than supposed (apparently she was unemployed), and then a month ago she has left and broken plenty of things in the flat, like windows, wardrobes, pullled out sockets, holes in the walls etc.

What can I do? How can I find her? She was getting housing benefit, so can I somehow find her that way? And if I find her, what are my chances of getting my money back, and how?

Am so, so upset. I would be so greatful for any advice you can give me. Thanks in advance
